Channel 4 Store– Terms and Conditions of Sale

The Channel 4 Store on the Channel 4.com website (“Website”) is owned by Channel Four Television Corporation of 124 Horseferry Road, London, SW1P 2TX (“Channel 4”, “we”, “us”) and operated on our behalf by Big Blue Sea Limited (“BBS”) whose company number is 07804381 and whose registered office is 6 New Street Square, London, EC4A 3LX and its website is www.bigbluesea.co.uk.

Please read these terms and conditions carefully as they govern the relationship between you and us and apply to your use of the Website and the goods and services offered by us on the Website. By accessing and/or placing an order you agree to be bound by the terms and conditions set out below (“General Terms”).

Your use of the Website is also subject to Channel 4’s Terms of Use, Privacy Policy and Cookies Policy which are located in the footer of this Website.

1 Parties and Age Restrictions

Minors under 18 years old can only use the Website and place orders with us with the prior consent of their parents or guardians. Only users over 18 years old may buy items that are restricted to adults (e.g. items with an 18 certificate).

You must have a billing address in the United Kingdom in order to use the Website and place an order with us.

2 Prices and payment

We try to ensure that all our prices are accurate, however, errors may occur. If we discover an error in the price of the goods you have ordered we will inform you as soon as possible and give you the option of re-confirming your order at the correct price or cancelling and refunding your order. We shall be under no obligation to fulfill an order for goods which were advertised at an incorrect price.

All prices are quoted in pounds sterling. Prices include Value Added Tax, unless otherwise specified and indicated.

You undertake that all details you provide to us for the purpose of ordering or purchasing goods are correct and that you are authorised to use Paypal account that you are using to purchase the goods.

We reserve the right to terminate special offers at any time prior to you placing an order and without notice to you.

3 Acceptance and Conclusion of Contract

Your order is an offer to buy from us. Payment for your order (including in respect of any pre-ordered items) is taken at the point at which you click 'pay now' on the PayPal account. You will then receive confirmation from Paypal that your order has been accepted and you will be directed back to the C4 Store. The acceptance of your payment constitutes our acceptance of your offer to buy goods from us and a contract is formed between you and us at this point.

Please note that we may refuse to process a transaction for any reason at our sole discretion. We will not be liable to you or any third party in the event that we refuse to process or we suspend any transaction after processing has begun.

We will confirm receipt of your order by sending you an email to the email address that you provide (the “Confirmation Email”). The Confirmation Email will contain details of the item(s) that you have ordered and will confirm the address that the item(s) will be sent to. When we dispatch your order, we will also send you an email to you confirming that your item(s) have been dispatched and giving you approximate timescales for delivery (the “Delivery Email”). We recommend that you add channel4store.co.uk to your ‘safe sender’ list and check that your online security software does not block emails from us.

4 Availability

If for any reason beyond our control, the goods selected are not available, our customer service team will notify you and offer you a substitute similar in quality, character and price or the option to cancel your order.

If part of your order is not available, you have the option to either delay the delivery of the goods until all goods are available, replace the goods with a substitute or cancel the order for the goods that are unavailable. In the event that you chose to wait for the completed order, the date of delivery will be determined by the availability date of the goods that are not available. We will advise you of the projected delivery date by email.

5 Terms of Delivery

Upon receipt of your order, and provided the item is in stock, we aim to dispatch the goods within 1 working day from the date of the Confirmation Email. Items that are ordered on pre-release will be sent in accordance with clause 9. Pre-orders. We use Royal Mail standard delivery for orders and do not usually require a signature for receipt. All efforts will be made to ensure delivery of the goods as quickly as possible.

6 Returns and Cancellation

Breakage and Shipment Not Received

In the unlikely event that your order is damaged, or the delivery is not received please notify us by contacting Customer Services (see clause 8 Customer Services for details) within twenty-one days from the date of the Confirmation Email and we will, at your option, refund or replace the goods at no additional charge to you. If a proportion of the goods in your order have been damaged you may choose to return the full delivery, just the damaged goods or request a refund.

Cancellation of an Order / Returns

You may cancel or return an order without explanation anytime before the order is dispatched or within 21 working days from the date of delivery, provided the goods have not been opened or tampered with. You may cancel an order by notifying us by email at orders@channel4store.co.uk. If the order has already been dispatched our Customer Services team will advise you of the return address and, on receipt of the adequately and securely wrapped item that is being returned and the corresponding invoice, we will refund the full price of the order plus the delivery charges to you. Refunds will be made via PayPal. Please allow 30 days for the refund to appear on your bank statement. All returns must be shipped in the original packaging to avoid further damage.

Refunds on promotional offers will be based on the terms of the promotional price.

7 Pre-Orders

The price in respect of pre-ordered items is fixed at the point at which you place your order and payment is taken. Pre-ordered items are shipped at least three days in advance of the release date but the exact delivery day cannot be guaranteed as it is subject to Royal Mail standard delivery timescales. Please refer to clause 6 Returns and Cancellations if you wish to cancel your pre-ordered item.

9 Retention Right

All goods shipped and delivered shall remain our property until payment (including shipping and handling costs) is actually received by us.

10 Intellectual Property Rights

In these General Terms, “Intellectual Property Rights” means patents, database rights, copyright, design rights (both registered and unregistered), trade marks (whether registered or unregistered) and other similar rights, together with the right to apply for protection of those rights. All Intellectual Property Rights in this Website are either owned by or licensed to Channel 4 or BBS.

Subject to the licence that we have granted to you to use this Website, we reserve all rights, title and interest in our Intellectual Property Rights in this Website.

11 Warranties

We warrant that the goods will be of satisfactory quality and free from material defects at the time of dispatch.

12 Our Liability to You

Our liability to you in connection with any order will not exceed the total price charged for the goods ordered. Nothing in these General Terms shall affect your statutory rights.

Nothing in these General Terms shall limit our liability for personal injury or death caused by negligence, willful default or by fraudulent misrepresentations. To the full extent allowed by applicable law, you agree that we will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to this Website.

We assume no liability for any errors or omissions on the Website and reserve the right to change information, prices, specifications and descriptions of listed goods, products and services.

We assume no responsibility for any links to the Internet or other third party websites contained within the Website and we shall not be responsible or liable for the content of any other websites on which you may visit from our Website.

13 Data Protection and Privacy Policy

We collect personal information provided by you via your use of the Website which we will use to enable us to fulfill and deliver your order. By providing your details, you consent to BBS and Channel 4 maintaining, recording, holding and using the information we collect to process your orders, to improve the service to you.

We will not pass your personal data to any third parties. We will use any personal information provided by us in accordance with the Channel 4 Privacy policy and cookies policy, which is located in the footer of this Website.

All data is collected lawfully and maintained in accordance with the Data Protection Act 1998.

We use “cookies” (which are small pieces of information sent by a web server to a web browser) to help us collect general information about the behavior of visitors to the Website. This helps us to constantly monitor and improve our website's functionality and service to you. 14 Miscellaneous

We are not be liable for any delay in delivering your order if that delay or failure is caused by circumstances beyond our control such as (but not limited to) civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, fire, flood, storm or act of God, failure of an ISP or telecommunications provider in connection with the performance of this Agreement.

If any of these General Terms are held by a court to be unlawful, invalid or unenforceable, in whole or in part this will not affect the validity of the remaining terms and conditions which will continue to be valid and enforceable to the fullest extent permitted by law.

These General Terms will be governed by the laws of England and Wales and any disputes will be decided by the English courts. Any written notice should be sent to Channel 4 Television Corporation, 124 Horseferry Road, London, SW1P 2TX.

We may update these General Terms from time to time without notice to you, so please check this page regularly to ensure that you are aware of the current General Terms that are in force. If you do not wish to accept the General Terms, you should not continue to use the Website.

In the event of any conflict between these General Terms and the Channel 4 Terms of Use, these General Terms shall prevail.

You may not assign, sub-license or otherwise transfer any of your rights under these General Terms. If you breach these General Terms and we ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these General Terms.
